Terms & Conditions

These Terms apply to the Dick Pick app, the website at dickpick.app, private betas, physical kits, and related features and services (together, the “Services”). By using the Services, you agree to these Terms.

1. What Dick Pick does

Dick Pick provides magic-performance software and, when offered, related physical performance products. The app creates an on-screen illusion inside the app. It does not alter the iPhone Home Screen or block operating-system gestures. Performers are responsible for using the app safely and appropriately during a show.

2. Accounts and security

Some features require an account, verified email, and a valid entitlement. Keep your password and activation codes private. You are responsible for authorized use of your account and for reporting suspected unauthorized activity. We may restrict access for fraud, security incidents, or violations of these Terms.

3. Physical kits and software licenses

A qualifying physical kit may include a single-use code that provides permanent access to the Dick Pick core app for one eligible account, subject to the product terms and verification. A code may not be sold, transferred, or redeemed by multiple accounts contrary to its stated restrictions. Physical kits, shipping, refunds, and other purchase terms will be clearly disclosed during checkout when sales open.

4. Apple purchases and optional subscriptions

Any direct iOS in-app purchases are handled through Apple's payment systems and subject to Apple's applicable purchase and refund policies. Optional subscriptions, if offered, must be expressly authorized; owning the core app does not require an optional subscription. We do not charge you merely for joining the Founder's List.

5. Beta testing

TestFlight builds and invitation codes are temporary, limited, and intended for evaluation. Beta access may expire or be revoked and does not grant permanent software ownership. Beta features may change, contain errors, or be unavailable without notice. Do not rely on a beta build for critical or time-sensitive performances.

6. Your content and permissions

You retain your rights to images, audio, or routines you create or supply. You grant us only the permission reasonably needed to store, process, display, or transmit content through the features you choose. You are responsible for ensuring you have rights to material you upload or share.

7. Acceptable use

Do not misuse activation codes, bypass license or security controls, interfere with the Services, upload unlawful or infringing content, impersonate others, or reverse-engineer the software except as permitted by applicable law.

8. Intellectual property

The Dick Pick software, site, designs, artwork, branding, and other materials belong to Dick Pick or its licensors. Your license allows authorized use of the software, not ownership of its underlying code or intellectual property.

9. Availability and disclaimers

We strive to keep the Services reliable, but performance, connectivity, availability, and compatibility can vary. To the maximum extent allowed by law, the Services are provided “as is” and “as available” without additional warranties. This does not remove rights that cannot be excluded by law.

10. Liability

To the extent allowed by law, we are not liable for indirect, incidental, or consequential losses arising from use or interruption of the Services. Nothing here excludes liability that cannot legally be limited.

11. Changes and termination

We may update these Terms and the Services from time to time. We may suspend or end access where required for security, compliance, or violations. Updated Terms will be posted with a new effective date.

12. Governing law and contact
